The website of the Partnership for Child Care Accreditation d/b/a
Chicago Accreditation Partnership (the "Site") is an online information
service provided by Chicago Accreditation Partnership ("CAP"),
subject to the terms and conditions set forth below. Please read
the following information carefully before using this Site. By
accessing or using this Site, you agree to be bound by the Terms
of Use. If you do not agree with any of the below Terms of Use,
do not use this Site. CAP reserves the right, in its sole discretion,
to modify, alter or otherwise update these Terms of Use at any
time. Any use of the Site constitutes your acceptance of the then
current terms and conditions. The terms and conditions herein
apply to CAP and its affiliates. The terms and conditions herein
are in addition to, and do not override, the specific terms and
conditions that apply to the products or services offered by CAP
through this Site. These Terms of Use apply to all users of this
Site, including registered users of CAP services.
Acceptance of Terms and Use Limitations
You agree and continue to agree to use this Site in a manner consistent
with the applicable laws and regulations and in accordance with
the terms and conditions set forth below. By using the Site, you
agree to be legally bound by the Terms of Use just as if you had

in CAP's discretion, restricts or inhibits any other person from

is the property of CAP and is protected by copyright, patent,

work under the U.S. copyright laws and is protected by worldwide
copyright laws and treaties. You agree not to copy, reproduce,

as expressly provided herein, CAP does not grant any express or
implied right to you under any patents, copyrights, trademarks,
trade names or trade secret information or the right to use any

Use of Communications/Unsolicited Ideas
Information delivered to this Site (whether via posting, electronic
mail, chat rooms or otherwise) shall not be considered by you
to be confidential. CAP shall not be responsible to keep such
information confidential and CAP shall not be liable for any use

is, and shall remain, the sole and exclusive property of CAP and
may be used by CAP for any purpose whatsoever, commercial or otherwise,
without compensation. CAP welcomes your comments about this Site

Limitation of Liability
CAP shall not be liable for any damages of any kind, including,
without limitation, indirect, special, statutory, punitive or
consequential damages arising out of your access to, or inability
to access, this Site, or any linked site or your use of, or reliance
upon, this Site or the Content hereof including, but not limited
to, lost profits, loss of use, business interruption, loss of
programs or other data, whether in an action based on contract,
tort or otherwise, even if CAP is expressly advised of the possibility
of such damages. Some jurisdictions do not allow the exclusion
or limitation of warranties or damages. Furthermore, you agree
to indemnify CAP against liability relating to any use of the
Site or Content and agree to indemnify, defend and hold harmless
CAP and any third party information providers to the Site from
and against all losses, expenses, damages and costs, including
reasonable attorneys' fees, resulting from any violation of these

Jurisdiction and Venue
Unless otherwise specified, the materials in the Site are designed
for use by United States residents only. This Agreement shall
be construed and governed by the laws of the State of Illinois,
notwithstanding any conflicts of law provision. You agree to submit
to the personal and exclusive jurisdiction of the state and federal
courts located within the State of Illinois. You agree that regardless
of any statute or law to the contrary, any claim or cause of action
arising out of or related to use of CAP's Site, Content or these
terms and conditions must be filed within one (1) year after such
claim or cause of action arises.
Severability
If any provision of these terms and conditions is found by a court
of competent jurisdiction to be invalid, the court shall endeavor
to give effect to the intention reflected in the provision, and
the other provisions of these terms and conditions shall remain
in full force and effect. The Terms of Use constitute the entire
agreement between the parties with respect to the subject matter
contained herein and supersedes all previous communications or
agreements, whether written or oral, between CAP and you.
International Use
Recognizing the global nature of the Internet, you agree to comply
with all local rules including, without limitation, rules about
the Internet, data, e-mail, or privacy. Specifically, you agree
to comply with all applicable laws regarding the transmission
of technical data exported from the United States or the country
in which you reside.
Miscellaneous
No waiver of any breach of any provision of these Terms of Use
shall constitute a waiver of any prior, concurrent, or subsequent
breach of the same or other provisions hereof. All waivers must
be in writing. CAP is not responsible for delay or failure to
perform due to causes beyond its reasonable control. Any rights
not expressly granted herein are reserved.
